Although there are numerous and significant differences between the theories of scientific growth and change proposed by Kuhn, Lakatos, and Laudan, they all hold that specific scientific theories should be viewed as constitutive of more comprehensive theories. Kuhn calls those more general theories ‘paradigms’, Lakatos labels them ‘research programmes’ and Laudan refers to them as ‘research traditions’. They all argue that scientists are much more willing to give up the specific theory within a given research programme rather than the programme (...) itself, and that individual theories should be viewed as attempts to increase the overall explanatory power of the more general theories, since the ultimate concern of the scientist is with the success of the general rather than the specific theory. When a basic theory or research programme is confronted with severe criticism, proponents attempt to protect the hard core or central elements of their programme through the invention of auxiliary hypotheses. Good auxiliary hypotheses adequately answer the objections for which they are designed, and suggest new avenues of research. In 1928, Arthur Holmes provided proponents of continental drift theory with an auxiliary hypothesis which afforded them a badly needed account of the forces responsible for continental drift. Although Holmes' proposal was not ultimately correct, it was the first plausible alternative offered by an exponent of the continental drift research programme. (shrink)

The Reputation of Justice Oliver Wendell Holmes, Jr., one of the chief architects of twentieth century American law, has gone through a number of phases, changing from being altogether praiseworthy in the last years of his life and the first years after his death in 1935 to that of more sober evaluations. Writing at mid-century Henry Steele Commager offered the judgment that Holmes had had about him “much of the Olympian [and] something of the Mephistophelean.” The most (...) useful account of how the winds of change swept along Holmes' reputation is an article by G. Edward White, “The Rise and Fall of Justice Holmes,” which appeared in the University of Chicago Law Review in 1971. White examined the myth of Justice Holmes as it obtained from 1932 to 1940 and then proceeded to describe the demythologizing of Holmes from 1941 through 1949. (shrink)

In this paper I argue that the “dynamic functionalism” of Dewey’s evolutionary approach to ethics – moral norms emerge to address specific problems but must be constantly readjusted to changing contexts – had its roots in the comparative jurisprudence of Sir Henry Sumner Maine and Oliver Wendell Holmes Jr. First, I will discuss the rise of the comparative sciences in the nineteenth century, part of the backdrop for the work of Maine and various evolutionary anthropologists. Next, I will (...) examine Maine’s Ancient Law (1861), Edward Burnett Tylor’s Primitive Culture (1871), and Holmes’s The Common Law (1881), three related books that set up a dichotomy between existing custom and historical progress. Finally, I will show how this dichotomy was reflected in Dewey’s writing and teaching at the University of Michigan in the early 1890s, including “Anthropology and Law” (1893) and several courses in political philosophy. There is compelling evidence that pain experience is influenced by cognitive states. We explore one specific form of such influence, namely placebo analgesia, and examine its relevance for the cognitive penetration debate in philosophy of mind. We single out as important a form of influence on experience that we termradical cognitive penetration,and argue that some cases of placebo analgesia constitute compelling instances of this phenomenon. Still, we urge caution in extrapolating from this to broader conclusions about cognitive penetration in perceptual (...) experience. Instead, we suggest that the cognitive penetration of pain raises distinctive psychological, epistemological, and ethical issues. (shrink)

Christof Koch and Klaus Hepp, in a recent essay in this journal1, issued a challenge to “those who call upon consciousness to carry the burden of the measurement problem in quantum mechanics.” Lest absence of a response be construed as admission of a failure of the idea that consciousness can play, via quantum measurement effects, a crucial role in neurodynamics, or that this idea has been in any rational way damaged by the arguments put forth in the cited article, I (...) respond here to that challenge. The powerful qualities view of properties is currently enjoying a surge in popularity. Recently, I have argued that the standard version of the view is no different from a rival view: the pure powers position. I have also argued that the canonical version of the powerful qualities view faces the same problem as the pure powers view: the dreaded regress objection. Joaquim Giannotti disagrees. First, Giannotti thinks that the standard version of the powerful qualities view can be differentiated from the (...) pure powers view. Second, Giannotti argues that the powerful qualities view is not susceptible to the regress objection. Third, he argues that there is another reasonable version of the powerful qualities view available, which makes use of the notion of ‘aspects’. In this note, I respond to Giannotti. I argue that all three of Giannotti’s arguments are unsuccessful. (shrink)

Here I discuss the basic elements, major stages, and completion of progressive evolution. The cosmic world of self-realization is based on extensive self-development within a closed contour: temporal counter-transitions of spatial counter-elements (energy bonds and media and, basically, substance structures) form of local worlds within it through evolution of informational structures. The organic world of reproduction develops through the open informational path: the initial substance, through energy exchange and metabolism, reproduces similar substance; the latter interacts with the environment and, subsequently, (...) reproduces its like, and so on. The animal world of self-regulation builds up a closed informational contour in the environment through the informational input and command output. The human world of self-cognition forms the intensive type of development within the internal closed informational contour of cognition. Counter-transitions of ideal images and signs relate to their real prototypes. In the course of cognition, abstractive thinking develops and brings man to the possibility of reflection of the initial world in its integrity (thus, elevates man to the infinite, by Hegel). [opening paragraph]: In his keynote paper David Chalmers defines ‘the hard problem’ by posing certain ‘Why’ questions about consciousness? Such questions must be posed within an appropriate setting. The way of science is to try to deduce the answer to many such questions from a few well defined assumptions. Much about nature can be explained in terms of the principles of classical mechanics. The assumptions, in this explanatory scheme, are that the world is composed exclusively of particles and fields governed (...) by specified mathematical laws that refer neither to any individual person, nor to anyone’s experiences. These physical laws are supposed to be such that particles and fields, acting in concert, can form causally efficacious real functional entities such as driveshafts and propellers. Similarly, surges of electrical and mechanical activity in appropriately designed material substrates, composed of particles and fields acting in concert, could implement, in the world of matter, complex functional structures and long sequences of logical operations. Thus it is conceivable that all of our behaviour, and all of the internal processing that occurs in our bodies and brains could be deduced, at least in principle, from the principles of classical mechanics and appropriate boundary conditions. -/- Contents: 1. Arguments pertaining to the mind-brain connection and to the physical effectiveness of our conscious choices have been presented in two recent books, one by John Searle, the other by Jaegwon Kim. These arguments are examined, and it is explained how the encountered difficulties arise from a defective understanding and application of a pertinent part of contemporary science, namely quantum mechanics. The principled quantum uncertainties entering at the microscopic levels of brain processing cannot be confined to the micro level, but percolate (...) up to the macroscopic regime. To cope with the conflict between the resulting macroscopic indefiniteness and the definiteness of our conscious experiences, orthodox quantum mechanics introduces the idea of agent-generated probing actions, each of which specifies a definite set of alternative possible empirically/experientially distinguishable outcomes. Quantum theory then introduces the mathematical concept of randomness to describe the probabilities of the various alternative possible outcomes of the chosen probing action. But the agent-generated choice of which probing action to perform is not governed by any known law or rule, statistical or otherwise. This causal gap provides a logical opening, and indeed a logical need, for the entry into the dynamical structure of nature of a process that goes beyond the currently understood quantum mechanical statistical generalization of the deterministic laws of classical physics. The well-known quantum Zeno effect can then be exploited to provide a natural process that establishes a causal psychophysical link within the complex structure consisting of a stream of conscious experiences and certain macroscopic classical features of a quantum mechanically described brain. This naturally created causal link effectively allows consciously felt intentions to affect brain activity in a way that tends to produce the intended feedback. This quantum mechanism provides an eminently satisfactory alternative to the classical physics conclusion that the physical present is 1 completely determined by the physical past, and hence provides a physicsbased way out of the dilemma that Searle and Kim tried to resolve by philosophical analysis.. Based on our respective research programs (psychiatry, forensic psychiatry, public health, HIV/AIDS, harm reduction) this article aims to use purposely non‐conventional means to present the substantial contribution of poststructuralist perspectives to knowledge development in nursing science in general and in our current research in particular. More specifically, we call on the work of Michel Foucault and Deleuze & Guattari to politicize nursing science using examples from our empirical research programs with marginal and often highly marginalized populations.
